Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service. It may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

In order to contract with www.littlesplodgers.com you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. www.littlesplodgers.com retains the right to refuse any request made by you. If your request is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be www.littlesplodgers.com or may in some cases be a third party. Where a contract is made with a third party www.littlesplodgers.com is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When making a payment you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Class Booking

In order to book classes you must be the named child’s parent or legal guardian. Please use the online booking form on the website or contact us via email info@littlesplodgers.com . All of our classes run weekly and are to be paid for termly in advance. A contract between us will not be formed until we send you confirmation by e-mail that the service which you require is available to you. Only those services listed in the confirmation e-mail sent at the time of confirmation will be included in the contract formed.

(b) Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods or service which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

(c) Payment
Upon receiving your booking we will ask you to make payment by Bank transfer. Once payment has been made we will send out a confirmation email detailing the class, location and time.

Cancellation

From time to time it may be necessary, due to unforeseen circumstances, to cancel or postpone a class. Or we may need to move or change a session. In the rare event that this may happen, we will provide an alternative option. Be that a make-up class or a different session. Where this is not applicable Little Splodgers will offer an online version of the session or (where this is not possible), a credit for future sessions. No refunds will be given.

If for some reason you miss a session we will try, where availability allows, to offer a make-up session on a different day or at a different venue. Please let us know as soon as is viable if you are unable to attend and wish to join a make-up class.

*Please note that this might not be possible during the current climate while COVID-19 guidelines are in place. But we will (on request), save your crafts for you so that you can come and collect them to do at home, or collect the following week so that the children don’t miss out.

Covid-19

At Little Splodgers we take the safety of all our Little Splodgers and their grown ups very seriously. We have always maintained high standards of cleanliness and hygiene within our sessions, ensuring all equipment is cleaned and hands are washed, however due to the current pandemic we are further increasing hygiene standards and safety aspects based on Public Health England advice.

We have implemented the following special measures in response to the Covid-19 outbreak:

• All of our teachers have completed multiple Covid-19 training courses, along with updating their first aid training. Certificates have been obtained for all of these courses.
• Government advice for adults is to stay alert and to continue to socially distance, at a distance of one meter plus where the two metre rule cannot be adhered to. We ask customers to please respect this and stay within safe distances of one another. In respect of younger children (early years/under 5’s) we understand that this may not always be possible and certainly more difficult to maintain, so we will be reducing the numbers in classes and adapting the layout of sessions to help our Little Splodgers and their grown ups to ensure that they remain safe at all times.
• For anyone booked into our classes, you must inform NHS immediately if you develop any symptoms for a test and give all contact details to their track and trace who will then be in touch with ourselves for customer details if needed.
• Additional cleaning measures will be put in place and hand sanitiser will be available for all to use on entry and exit to venues.

• Our session plans will have been adapted to adhere to guidelines, and the sharing of equipment will no longer be permitted. All of the equipment given out for use within the sessions will be single use including, but not limited to all paintbrushes and paint, glue pots and glue and any pots used to deliver materials.
•  We will encourage regular washing and sanitising of hands.
• Class times will start and finish punctually to ensure there is no busy crossover between separate groups. And class times have been adjusted to make sure there is adequate time between classes to avoid this –  and also to allow for cleaning and sanitising of all hard surfaces such as chairs, tables, door handles, mats etc.

In addition to this there are a few practical steps that we ask you to follow when attending Little Splodgers classes to ensure everyone is kept safe at all times:

DO

• Cover your mouth and nose with a tissue or your sleeve/arm (not your hand) when you cough or sneeze.
• Put any used tissues, wipes, nappies or rubbish into the bins on site or place into a bag/nappy sack and dispose of safely at home.
• Wash your hands with soap and water often for 20 seconds, and also use hand sanitiser gel whenever needed.
• Keep within the social distancing guidelines, and be alert at all times to ensure children are maintaining this also, as much as possible.

Don’t

• Touch your eyes, hands or mouth if your hands are not clean
• Come to class if you or your Little Splodger are unwell or you suspect that you have come into contact with someone that is unwell or may have Covid-19.

 We will continue to monitor the situation closely and our policies will be under constant review should guidance change.

• If for any reason due to Covid-19 we are forced to close our doors – we will do our utmost to make up the missed weeks – by adding extra weeks either in the middle (during half term), or at the end of term – so that you won’t miss out on any classes. If we are forced to shutdown for a longer period of time we will endeavour to deliver the classes to you online.

Little Splodgers will have no further liability whatsoever in case of any events or proceedings that are outside of it’s control including, but not limited to any pandemic or coronavirus.

Force Majeure Event
Force Majeure means an event beyond the reasonable control of Little Splodgers including but not limited to strikes or other industrial disputes, (whether involving the workforce of Little Splodgers or any other party), failure of a utility service or transport network, act of God, notifiable disease, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

Little Splodgers shall not be liable to the Customer as a result of any failure to perform its obligations under this Contract as a result of a Force Majeure Event.
If the Force Majeure Event prevents us from providing services, we shall, without limiting our other rights or remedies and without liability to the Customer, have the right to terminate classes immediately by giving written notice to the Customer.

Adverse Weather
Little Splodgers is under no obligation to refund lessons that may be missed due to local adverse weather when the venue and environs are safe and accessible and lessons are held. We regret that we are unable to offer automatic refunding or rescheduling of lessons in the event of adverse conditions local to yourselves preventing you from attending a scheduled class.

Safety
All participants take part in classes at their own risk. Whilst we take all reasonable steps to make the classes safe, neither we nor Little Splodgers can accept any liability for any injury or damage suffered by any participant or any other person in a class.
Neither us nor Little Splodgers accept any liability arising from the medical condition of any participant.

Use of small objects

Children should be supervised, and their attending adult must be present at all times (regardless of age).  The use of small objects like googly eyes, sequins, beads, buttons etc. could be a potential choking hazard, so you must always be aware of this, and care must always be taken for attending adults to supervise their little ones at all times. 

Cancellation Policy

We operate a 4 week notice cancellation policy. At any point in the term, for whatever reason, you are able to give 4 weeks notice to leave. If you do wish to give notice it must be done in writing, via email, and the notice will run for 4 weeks from the date of notification.

Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law www.littlesplodgers.com and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable, or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and www.littlesplodgers.com. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of www.littlesplodgers.com.
